Once the product has been selected, you can click on &#8220;Add to cart&#8221; and continue shopping if you wish, otherwise, to finish the purchase you can click on &#8220;Finish purchase&#8221;. We guarantee that each of the transactions carried out is secure, for this our Website uses the <em>Redsys<\/em> payment processing platform as a payment gateway. All operations involving the transmission of personal or banking data are carried out using a secure environment. By clicking on &#8220;Place Order&#8221; you are confirming that the credit or debit card is yours.   <\/li><\/ul><p>To minimise the risk of unauthorised access, your credit or debit card details will be scrambled. If no transfer has been received within two (2) days, it will be understood that the order has been cancelled. <\/li><\/ul><p>Once the purchase has been made, the user will receive a first email with the purchase information, subsequently, they will receive a call from our sales team to determine and specify the price and estimated delivery time.<\/p><ol start=\"4\" class=\"wp-block-list\"><li><strong>Shipping Policy<\/strong><\/li><\/ol><p><strong>4.1 Geographical coverage<\/strong><\/p><p>The products offered through this Website are available for shipment throughout the Peninsula, France and Portugal.<\/p><p><strong>4.2 Transport and shipping costs<\/strong><\/p><p>The delivery and transport service is outsourced.<\/p><p>Shipping costs are not included in the price of the products offered by LIFTISA, these will be determined later taking into account the type of product, the delivery address and the size of the lifting platform.<\/p><p>LIFTISA will indicate on each purchase the maximum and approximate delivery time of the products. Both the user and LIFTISA may expressly agree on fast or partial deliveries. <\/p><p><strong>4.3 Delivery and reservation of title<\/strong><\/p><p>LIFTISA reserves ownership of the goods until the user has paid the agreed and accepted price in full. Upon receipt of full payment, LIFTISA shall be entitled to regain possession and control of the products, in accordance with applicable law. <\/p><p>The products will be considered delivered at the time they leave LIFTISA&#8217;s warehouse.<\/p><p>In the event of a delay in delivery times, the user undertakes not to demand any compensation from LIFTISA for any damages that may have been caused by the delay or lack of delivery.<\/p><ol start=\"5\" class=\"wp-block-list\"><li><strong>Exchange and Return Policy<\/strong><\/li><\/ol><p><strong>5.1 Right of withdrawal<\/strong><\/p><p>As a consumer, you have the right to withdraw from this contract within fourteen (14) calendar days without the need for justification from the delivery of the goods.<\/p><p>The withdrawal period will expire after fourteen (14) calendar days from the day you or an authorized third party, other than the carrier or courier, received the purchase. The communication of withdrawal must be sent by one of the means indicated below, before the end of the indicated period. <\/p><p>To exercise the right of withdrawal, you must notify LIFTISA, by email, of the decision to withdraw from the contract by means of an unequivocal statement.<\/p><p>In the event that the user wishes to exercise their right of withdrawal, it is important that they know that the costs arising from the return of the product will be borne by them, as well as any cost as compensation for the wear or damage of the lifting platform.<\/p><p>LIFTISA will have a period of fourteen (14) calendar days to refund the money either from the date on which it has received the notification of withdrawal, once it has received the lifting platform or the user has presented it with proof of the return.  <\/p><p>The exercise of withdrawal from the purchase transaction implies the withdrawal of the commercial guarantee.<\/p><p><strong>5.2 Exclusions to the right of withdrawal<\/strong><\/p><p>In accordance with the provisions of article 103 c) of Royal Legislative Decree 1\/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, the right of withdrawal will not apply in the event that the lifting platform has been adapted or customised at the request of the buyer.<\/p><p><strong>5.3 Returns<\/strong><\/p><p>On the Website you can consult the product sheets of each merchandise available for sale, in them LIFTISA details the characteristics, content and specifications of the lifting platforms and products it offers, however, this file could change without prior notice.<\/p><p>Any characteristics, weights, measurements or similar descriptions are indicated by approximation and their mention is to give information, trying to accurately show the characteristics of our products, including colors, which may vary slightly according to the user&#8217;s screen or vision mode.<\/p><p>For this reason, LIFTISA does not accept returns. However, LIFTISA may accept a return as long as the lifting platform or the goods are unused and in perfect condition, including all its accessories and documentation. In this case, the shipping costs returned to LIFTISA&#8217;s warehouses will be borne by the buyer.    <\/p><p>Once the product has been received by LIFTISA, the amount of the purchase will be refunded within forty-eight (48) hours, as long as the product is in perfect condition. The refund of the amount will be carried out through the same means of payment used by the user at the time of making the payment of their order. <\/p><ol start=\"6\" class=\"wp-block-list\"><li><strong>Guarantee<\/strong><\/li><\/ol><p>The warranty period will be one (1) year from the date of delivery of the lifting platform.<\/p><p>LIFTISA will be liable to the user for any lack of conformity that exists at the time of delivery of the lifting platform. Under the terms of the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws, the consumer is recognized as having the right to repair the lifting platform, the price reduction or the termination of the contract. <\/p><p>It is understood that the lifting platform is in accordance with these Terms, unless proven otherwise, when it conforms to the description made by LIFTISA in the product sheet of the Website; when it is suitable for the use for which a lifting platform of the same type is ordinarily intended; when it presents the usual quality and performance of a lifting platform of the same type that the consumer can reasonably expect in view of its nature.<\/p><p>There will be no liability for any lack of conformity that the user knew or could not reasonably have been unaware of at the time of acceptance of these Terms, as well as for those of which he has been specifically informed and has expressly and separately accepted.<\/p><p><strong>6.1 User Rights<\/strong><\/p><p>In the event of non-conformity of the lifting platform, the beneficiary of the guarantee will be entitled to repair.<\/p><p>The reduction of the price and the termination of the contract will proceed, at the user&#8217;s choice, when the user is unable to demand the repair or it has not been carried out within a reasonable period of time or without major inconvenience to the user. The resolution will not proceed when the lack of conformity is of little importance. <\/p><p>The repair suspends the calculation of the period indicated above. The suspension period will begin from the time the user makes the lifting platform available to LIFTISA and will conclude with the delivery of the repaired lifting platform to the user. During the twelve (12) months following the delivery of the repaired lifting platform, LIFTISA will be liable for the lack of conformity that led to the repair, presuming that it is the same lack of conformity when defects of the same origin as those initially manifested are reproduced in the lifting platform.  <\/p><p>The beneficiary of the guarantee may not demand in any case the replacement of the used lifting platform.<\/p><p><strong>6.2 How to enforce the warranty?<\/strong><\/p><p>In order to assert their right, the user must notify LIFTISA of the lack of conformity found, as soon as possible from the time they become aware of it.<\/p><p>Failure to comply with this communication will not result in the loss of the user&#8217;s right, but the user will be responsible for any damage caused to the lifting platform due to the delay in communication.<\/p><p>LIFTISA will not be liable for those parts or elements of the lifting platform that are manipulated by the user, or when the user has repaired the lifting platform without LIFTISA having given its authorisation or having had the opportunity to previously verify the alleged lack of conformity, unless due to the circumstances in which the event that gave rise to the repair occurred, it is not possible to comply with those requirements.<\/p><p>In the absence of proof to the contrary, it shall be presumed that the lack of conformity which manifests itself during the warranty period already existed when the lifting platform was delivered, except where this presumption is incompatible with the nature of the goods or the nature of the lack of conformity.<\/p><p><strong>6.3 Enforcement of the guarantee<\/strong><\/p><p>Once LIFTISA has been informed by the buyer of the lack of conformity, and once its existence has been verified, will determine the way and manner of carrying out the repair and also the place\/workshop where the lifting platform must be examined and, where appropriate, repaired. This repair will conform to the following rules: <\/p><ol class=\"wp-block-list\"><li>The repair will be free of charge for the user. This free of charge will include the expenses necessary to remedy the lack of conformity, especially transport, labour and materials. <\/li><\/ol><ol class=\"wp-block-list\"><li>In the event that the incorporation of spare parts is necessary, reconditioned, rebuilt or used parts may be used, provided that the following requirements are met:<\/li><\/ol><ul class=\"wp-block-list\"><li>That it is technically possible to repair the lifting platform using such parts.<\/li>\n\n<li>That the incorporated part has a state of conservation in accordance with the Terms and the product sheet.<\/li>\n\n<li>That, where appropriate, they are not active elements or assemblies of the braking, suspension and steering systems of the lifting platform.<\/li><\/ul><p>LIFTISA must inform the user in writing indicating the repairs carried out and the parts replaced.<\/p><p>However, the buyer may express his desire to install new parts, with acceptance of payment of the surcharge that this entails. In this case, the conformity of the new part purchased with these Terms is guaranteed. <\/p><ol class=\"wp-block-list\"><li>The repair must be carried out within twenty (20) working days from the delivery of the lifting platform to the workshop\/place that LIFTISA decides. The time it takes for the spare parts to arrive, from the date of order to the date of delivery, duly accredited by LIFTISA, will be deducted from this period. <\/li><\/ol><p><strong>6.4 Cases where repair is not possible<\/strong><\/p><p>If the repair is not technically possible, or is not satisfactorily carried out within the aforementioned period, or entails greater inconvenience for the buyer, or once the lifting platform is completed it is still not in accordance with the provisions of these Terms, said buyer may choose between reducing the price or terminating the contract, with the following details:<\/p><ol class=\"wp-block-list\"><li>The price reduction will be proportional to the difference between the price at the time of acceptance of these Terms and the value that the good effectively delivered had at the time of said delivery due to the lack of conformity.<\/li>\n\n<li>The resolution will not proceed when the lack of conformity is of little importance.<\/li><\/ol><p><strong><u>IMPORTANT: <\/u><\/strong>Normal wear and tear of parts, materials or components of the lifting platform is not considered to be non-conformity. Similarly, breakdowns or deficiencies of the lifting platform: <\/p><ol class=\"wp-block-list\"><li>That are motivated by the normal wear and tear of parts, materials or components.<\/li>\n\n<li>That are motivated by improper use of the same or by the lack of maintenance operations recommended by LIFTISA.<\/li>\n\n<li>That are the result of a theft or accident.<\/li><\/ol><ol start=\"7\" class=\"wp-block-list\"><li><strong>User Conduct<\/strong><\/li><\/ol><p>The information you provide to the Website will be used only for the correct management of the products offered by LIFTISA.<\/p><p>The user undertakes to use the information contained in this Website exclusively for their own needs and not to directly or indirectly carry out any type of commercial exploitation of the products, contents and services to which they have access.<\/p><p>Through registration, the user acknowledges and accepts that the data entered is complete, accurate and up-to-date, being the only way to correctly process orders. The execution period for contractual performance will be extended for a period of time equivalent to that for which the failure to perform the obligation has been prevented, provided that there is an agreement between the parties. <\/p><p>Likewise, LIFTISA cannot be held liable for the breach of the contract entered into in the event of non-existence or unavailability of the product or the material, parts or components used for its manufacture, due to total or partial disruption or strike, in particular, of postal services and means of transport and\/or communications.<\/p><p>The causes of Force Majeure described above shall include any act, event, failure to exercise, omission or accident which is beyond our reasonable control.<\/p><p><strong>10.2 LIFTISA&#8217;s Liability<\/strong><\/p><p>LIFTISA will not be liable under any circumstances for damages such as accidental or indirect losses, economic damages or loss of profit, loss of profit, loss of production or damages arising from claims from users or users&#8217; customers.
